This Privacy Policy (“Privacy Policy”) describes the types of information Creative Maven, Inc. (“Creative Maven”, “us”, “our”, and “we”) may collect from you or that you may provide when you visit the Site to obtain information about us, as well as our practices for collecting, using, maintaining, protecting, and disclosing that information. 

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using this Site, you agree to this Privacy Policy.

This Privacy Policy is intended to be read side by side with our Terms of Use, which is incorporated herein by reference.  Capitalized terms used but not defined in this Privacy Policy have the same meanings as provided in the Terms of Use.  Please note that we may revise and update this Privacy Policy from time to time in our sole discretion.  All changes are effective immediately when posted and apply to all access to and use of the services and the Site thereafter.  Your continued use of the Site or following the posting of changes means that you accept and agree to the changes.  It is your responsibility to check periodically for changes, as these changes are binding on you.  If you do not agree to this Privacy Policy, please do not use the Site or any of the Creative Maven services.

  • Through our Professional Services, except as set forth below.

  • Us offline or through any other means, including on any other website operated by any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Site or in connection with our Professional Services offerings, including but not limited to third-party services used by us in connection with virtual classes or consultations such as communication tools like Go To Meeting, iMessage, Messenger, Microsoft Teams, Skype, WeChat, WhatsApp, Slack or Zoom, and file-sharing tools like Dropbox, Microsoft Teams, OneDrive or SharePoint or equivalent.

Types of Information We May Collect

We may collect information, including personal information and non-identifiable information, when you use the Site or interact with us on the Site or as part of our Professional Services.  For example, we may collect personal information when you contact us, create an account with us, access or use our Site or resources, respond to our emails, refer others to us, and submit registration forms and surveys.

We may collect several types of information from and about you on our Site, including:

  • Information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, your IP address or any other identifier by which you may be contacted online or offline.
  • Information about your internet connection, the equipment you use to access our Site and usage details.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Creative Maven's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Creative Maven about our Site and users is among the assets transferred.

  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Creative Maven, our customers, or others.

 How We Collect Information

As you navigate through and interact with our Site, automatic data collection technologies may collect certain information. 

The technologies we may use for this automatic data collection include:

  • Cookies (or browser cookies).A cookie is a small file placed on the hard drive of your computer or your mobile device. You may refuse to accept browser Cookies by activating the appropriate setting on your browser or device. However, if you select this setting you may be unable to access certain parts of our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.  We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

If you would prefer to not use a third party communication tool suggested by Creative Maven, please let Creative Maven know and we will work with you to use your preferred tool with settings and technologies that you are comfortable with using.  We may ask that you provide us with our own log-in and our own account for such a tool.

Security of Personal Information

We have implemented measures to reasonably safeguard your information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Accessing and Correcting Personal Information

You can access, update and delete personal information you provided to us, as described below, by sending us an email at [email protected].

While we are ready to assist you, we may not always be able to delete records of past interactions and/or transactions for example, if we believe the change would violate any law or legal requirement or cause the information to be incorrect or is otherwise necessary for us to provide you with Professional Services or enforce our rights under a contract with you.  We will not attempt to re-identify information or data that has been de-identified or aggregated.  

California Privacy Rights 

California residents under this Privacy Policy may have further rights, including requesting certain information regarding our disclosure of personal information to third parties for direct marketing purposes.  To make such a request, please email us at:  [email protected].  Please allow up to 45 days for a response.  

Please note that it is Creative Maven’s practice to only use your personal information for direct marketing purposes if you have opted-in to such direct marketing.  Otherwise, Creative Maven has not and will not knowingly share your personal information with third parties for their direct marketing purposes. 

Notice to Residents of Countries outside of the United States of America (“U.S.”)

This Site is for use only by persons located in the U.S.  Accordingly, compliance with non-U.S. privacy and data protection requirements is outside the scope of this Privacy Policy.  If you reside outside of the U.S. or are a resident of a jurisdiction outside of the U.S., we ask that you do not use this Site.  

Children’s Privacy

The Site, as well as our Professional Services, are not directed at individuals under the age of thirteen (13).

By using our Site, you represent that you are at least thirteen years old and understand that you must be at least thirteen years old to use our Site.
